Terms & Conditions

1. Special Requests/Coverage

The photographic coverage will be as Barker&Mogg The Photographer determines and The Client understands and accepts that. No one photograph is to be deemed more important than another. Although every effort is made to comply with The Client’s wishes, any special requests will not be regarded as binding instructions. 

2. Images

Barker&Mogg The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is not always possible to record the exact colour as seen by the human eye. 

3. Retouching

The Client accepts that Barker&Mogg The Photographer will perform a standard amount (as a minimum) of retouching in order to give the photographs a quality which he considers appropriate.

4. Copyright

The Copyright Designs and Patents Acts 1998 assigns the copyright of the images to “The Photographer”. The Photographer assigns limited rights to “The Client”. “The Client” may copy, reproduce and distribute the photographs for personal use only. This is known as a “license to print”.

The Photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting his work or any other use.

The Client is not authorized to copy and/or pass any photographs or derived products to any third-party person and/or organization for commercial use without first gaining permission in writing from the copyright owner (The Photographer).  

5. License

Barker&Mogg The Photographer shall be granted complete artistic license, including in relation to the locations chosen and the photographed poses. The Photographer’s judgement regarding the locations and poses as well as the number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects, it may not be possible to capture all the desired images.

6. Number of Images

All images presented to The Client are final selection. Any other images taken by The Photographer that are not presented have not passed quality control and therefore will not be processed or released to The Client.

7. Images

Images will be supplied via digital download. Barker&Mogg The Photographer strongly advise The Client to immediately copy/back-up any supplied images from this download to a suitable computer or storage device. Digital storage devices cannot be guaranteed indefinitely. Also, please note that Barker&Mogg (Justin Hoffmann) is under no obligation to keep copies of your images once released.

8. Liability

In the unlikely event that Barker&Mogg The Photographer is unable to perform your photoshoot due to injury, illness, act of God, act of terrorism, or other cause beyond his control, he will endeavour to give as much notice as possible and will make every effort to secure a session as soon as possible at a later date.

In the unlikely event that digital files are lost, stolen or destroyed for reasons beyond Barker&Mogg’s The Photographer’s control, including but not limited to camera, hard drive or equipment malfunction, Barker&Mogg’s liability is limited to the return of all payments received for the photoshoot.

9. Animal Welfare

The welfare of any pet or animal is of uppermost importance. For that reason, no photographs of animals in fancy dress will be commissioned nor will any services be provided to establishments that do not have animal welfare as a key consideration. Pets and animals feel more relaxed in familiar surroundings or in an open environment, and this will help them to contribute more of their natural character to the session. Animal psychology plays a key part in the photo shoot, and understanding animal behaviour is fundamental to capturing your pet looking relaxed and how you would like to see them. 

10. Complaints

Any complaints should be raised by The Client with Barker&Mogg The Photographer, in writing, within 28 days of receipt of the images.
